Driver Who Police Said Swerved At Officer Faces Felony Theft Charge

POSTED: 4:16 pm CDT August 28, 2008
UPDATED: 4:38 pm CDT August 28, 2008

The man shot by a state trooper Wednesday after he tried to elude them now faces felony theft charges.

Matthew Loth was facing a fugitive from justice charge but the charge has been dropped.

Loth will appear at his first court hearing at 8 a.m. Friday in the Sarpy County jail courtroom.

He still faces attempted murder charges for aiming his car at a trooper during the chase.

Authorities said Loth, 31, was driving the Nissan sports car that plowed into numerous vehicles Wednesday as he tried to flee from police and the state patrol.

Iowa State Patrol trooper Tim Sieleman fired multiple shots into the side of the car as Loth veered at him, the state patrol said.

Sieleman's bullets struck Loth, who was treated at Creighton University Medical Center.

The chase shut down the South Omaha Bridge from the South Expressway to South 11th Street.
